Terms and Conditions
- Definitions
1.1 “Booked Date” refers to the date the hire is to take place.
1.2 “Booking” refers to an application for hire of the Community Room/s at the Spinal Life Healthy Living Centre.
1.3 “Booking Request Form” refers to the form which must be completed by the Hirer applying to make a Booking at the Centre (Page 1).
1.4 “Centre” refers to the Spinal Life Healthy Living Centre.
1.5 “Community Room” refers to the two rooms allocated for external and internal use with equipment and technology available to host Bookings.
1.6 “Hirer” means the individual or group representative whose name is on the Booking Request Form and who has agreed to the Terms and Conditions of the Booking Service Agreement
1.7 “Terms and Conditions” refers to the terms and conditions of the Booking Service Agreement. - Booking Conditions
2.1 Spinal Life reserves the right to
2.1.1 Refuse an application for hire of Community Rooms.
2.1.2 Alter a Booking at any time.
2.1.3 Cancel a Booking at any time.
2.2 An application to hire the Community Rooms is not confirmed until:
2.2.1 The Hirer has paid for the booking; and
2.2.2 All conditions as specified on the Booking Request Form have been complied with.
2.3 The Hirer will indemnify Spinal Life Australia against all claims, losses, actions, damages, costs and expenses whatsoever, including for personal injury, or death, or damage to any property, to the extent arising from the use of the Community Rooms and any equipment during the Booking, or caused directly or indirectly by any action or omission of the Hirer or their guests or attendees failure to comply with the Terms and Conditions.
2.4 The Hirer is required to pay for any damage or cleaning requirements caused by the Booking.
2.5 The Hirer will not use Spinal Life’s trademark, logo, insignia or name without written consent from Spinal Life.
2.6 Bookings can be booked for a minimum of one hour. - Credit Card
3.1 Credit card details are required and may be charged, in addition to the agreed room hire rate, in the following instances:
3.1.1 The Booking is cancelled less than seven (7) days from the Booked Date;
3.1.2 The Booking is intact, but the booked area is not used;
3.1.3 Damage has occurred to the Centre facilities and surrounds;
3.1.4 Additional areas not specified on the original Booking are used;
3.1.5 Any person involved in the Booking fails to exit the building at the specified time.
3.1.6 Failure to comply with clause 9.1.
3.2 If any false or misleading information is provided regarding the nature of a Booking, Spinal Life reserves the right to cancel the Booking and charge the Hirer’s credit card. - Payment
4.1 The total Booking payment is due seven (7) days prior to the Booked Date. Failure to make payment in full by this date may result in the Booking becoming void and an administration fee being charged to the Hirer’s credit card. - Cancellations or Amendments
5.1 After receiving confirmation of the Booking, amendments to the Booking may be made by the Hirer up to 48 hours prior to the event where approved by Spinal Life.
5.1.1 14 days’ written notice from the Booked Date must be provided to cancel a booking for full refund of the Booking payment, less an administration fee.
5.1.2 Cancellations made less than seven (7) days and more than 48 hours from the Booked Date will not be eligible for a refund of the Booking payment.
5.1.3 Cancellations made within 14 days of the Booked Date due to extenuating circumstances must be made to Spinal Life for special consideration.
5.2 Spinal Life is not liable for any interference or cancellation of an event in a venue which is caused by civil disruption, industrial action, terrorism, act of God, or any circumstances beyond the direct control of Spinal Life and will not be obliged to settle any dispute or control any disruption which has been caused. - Conduct
6.1 The Hirer is solely responsible for the conduct of all persons at the facility during the hire period, including those who have not been invited but have gained access to the area.
6.2 The area surrounding the Centre is a community area, so all attendees or guests must behave in a respectful manner when leaving the venue. - Prohibited Items
7.1 Prohibited items not allowed in the Centre, Community Rooms or surrounds include, but are not limited to
7.1.1 Illegal substances/items;
7.1.2 Amplification devices not approved by Spinal Life;
7.1.3 Items with open flames including candles;
7.1.4 Smoke/fog machines;
7.1.5 Glitter/confetti; or
7.1.6 Blu-tack, sticky tape, tacks, nails and staples.
7.2 Decorations must be discussed with Spinal Life prior to use and are permitted provided they do not damage any surface or equipment and are removed within the Booking time.
7.3 The Hirer agrees:
7.3.1 Not to attach anything to the walls unless the attaching materials are preapproved by Spinal Life.
7.3.2 To abide by any rules or laws applicable.
7.4 The Centre is a non-smoking venue, and no smoking is permitted on the grounds. - Set-up and Pack-down
8.1 The Hirer agrees to set-up, pack-down and clean the requested Community Room(s) area within the allotted Booking times.
8.2 Furniture requested on the Booking Request Form that is to be provided by Spinal Life will be available in the Community Rooms and setup is a standard layout, but any further setup is the responsibility of the Hirer. - Cleaning
9.1 Cleaning is to be completed during the Booking by the Hirer and is included in the Booking time. This includes, but is not limited to:
9.1.1 Ensuring all rubbish from the Booking is placed in the bins provided. Any additional rubbish must be removed and is the responsibility of the Hirer to dispose of.
9.1.2 All surfaces and equipment are to be wiped down and cleaned.
9.1.3 All equipment and items used during the Booking is to be cleaned and packed away.
9.1.4 All furniture used during the Booking must be returned to its original position in the room.
